This page describes the terms governing the protection of intellectual property of LLC "BUKOVEL" (hereinafter – the "Company") and the use of materials of LLC "BUKOVEL" published on the Website, the official Instagram page and the official Facebook page (hereinafter – the "Website", the "Official Instagram Page", the "Official Facebook Page").
1. Protection of intellectual property
1.1 The Company hereby informs that the designation "BUKOVEL / БУКОВЕЛЬ" is a registered trademark and an intellectual property object protected by the legislation of Ukraine and international intellectual property laws.
The Company’s rights to the trademark are confirmed, in particular, by the Ukrainian Trademark Certificate No. 286752 issued in accordance with the Law of Ukraine "On Protection of Rights to Marks for Goods and Services" and registered in the State Register of Certificates of Ukraine on 25 November 2020. The Company also owns a number of other intellectual property objects related to the "BUKOVEL" brand.
1.2 In accordance with the legislation of Ukraine, the Company, as the trademark owner, has the exclusive right to:
- use the trademark in commercial and public activities;
- permit or prohibit its use by third parties;
- demand cessation of any unlawful use;
- claim damages or financial compensation.
The trademark is considered used not only in the case of direct reproduction but also when confusingly similar designations are used, including on the Internet, social media, domain names, event titles, advertising materials or information resources.
1.3 Without the Company’s consent, the following actions are prohibited:
- use of the name "BUKOVEL / БУКОВЕЛЬ" in titles of events, conferences, forums, commercial or public projects, or in any advertising activities;
- creation or dissemination of information that may create a misleading impression of partnership, affiliation or endorsement by the Company;
- use of the brand to enhance recognition, reputation or commercial attractiveness of third-party initiatives.
Such actions shall be considered a violation of intellectual property rights and, in the case of dissemination of inaccurate information, interference with the business reputation of the rights holder.
1.4 In the event of unlawful trademark use by third parties, Ukrainian law provides for the following measures:
- demand for immediate cessation of the infringement;
- obligation to remove or amend relevant materials;
- compensation for damages or financial recovery;
- legal protection in court;
- applying to online platforms, regulatory or antimonopoly authorities.
1.5 The Company systematically monitors the use of its trademark and applies legal protection mechanisms where violations are detected, including issuing formal cease-and-desist demands.
1.6 Use of the designation "BUKOVEL / БУКОВЕЛЬ", trademarks, trade names, logos and other intellectual property objects by third parties is permitted only under a duly executed license agreement.
License agreements are concluded at the Company’s sole discretion following review of a request submitted via email to anna.suhova@bukovel.com, including contact details and a description of the intended scope, method and duration of use.
Royalty fees are determined using an economically justified methodology considering the nature of use, scale of the project and the brand’s commercial impact.
The Company may request additional information necessary to decide on the license agreement, including commercial use and royalty conditions.
Any use without a license agreement is strictly prohibited.
2. Protection of Website, Instagram and Facebook content
2.1 Materials published on the Website, Official Instagram Page and Official Facebook Page are intended solely for personal non-commercial use. All materials, including news, photos, images, illustrations, audio and video clips (hereinafter – "Materials" or "Content"), are copyrighted and owned or controlled by the Company or lawful content providers.
Users accessing Materials must comply with all copyright notices, legal information and restrictions displayed.
2.2 The content is protected by Ukrainian law and international copyright regulations. Any modification, publication, transmission, participation in transfer or sale, reproduction (except as provided in clause 2.4), creation of derivative works, distribution, public performance or other use of Website, Instagram or Facebook content, in whole or in part, without prior written consent of the rights holder is prohibited.
2.3 Trade names, trademarks, logos and other intellectual property objects displayed are protected by applicable law.
Nothing in this section shall be interpreted as granting any license or right to use trademarks, patents, designs or copyrights of the Company or third parties.
2.4 Downloading or copying Materials is permitted solely for personal non-commercial use provided all copyright notices and legal disclaimers are preserved.
Any other copying, storage, reproduction or use is strictly prohibited without prior written consent of the Company.
2.5 The Company may grant written permission to use Materials at its sole discretion following a request submitted to anna.suhova@bukovel.com
with contact details.
Use is permitted only after receiving written approval.
2.6 Unlawful use of Content or violation of intellectual property rights of LLC "BUKOVEL" may result in civil, administrative or other liability under Ukrainian law.
